Prelim hearing May 28th + background
Jason R. Mackie waived his right to a preliminary hearing in court Wednesday May 28th at 9:15 am where judge, Sean E. Gallagher, was going to determine whether or not there was enough evidence for Mackie to stand trial. By waiving his right to prelim, he and his attorney, David Solfanelli, are admitting there is definitely enough evidence for the state to move the case forward to trial. The case was initially transferred by the Honorable Sean P. McGraw. Mackie was officially charged by the Commonwealth of Pennsylvania on four separate counts relating to theft of over $100,000 from the Greater Carbondale YMCA. These four charges are described in magisterial court documents as: theft, theft by unlawfully taking movable property, receiving stolen property, and accessing of financial device (other reason) by unauthorized issuer. Last May, WNEP reported “In recent months, there's been a shakeup in leadership at the Greater Carbondale YMCA. Board members say the former president, William Farber, stepped down earlier this year, and according to court paperwork, former executive director Jason Mackie stepped down last month.” But it did not mention that Mackie had a minor history of financial impropriety as he also had a civil court case against Chase Bank in 2010. He apparently owed the bank over $3,000 and was eventually ordered to pay over $3,219 to Chase Bank by the honorable Sean Gallagher.
